Terms and Conditions

These terms and conditions (the “Terms”) govern the booking of accommodation and facilities at Cromore Retreat and include the Hot Tub and Sauna Safety Rules set out in Schedule 1. Please read them carefully. By making a Booking, the Lead Guest accepts these Terms, including the Safety Rules in Schedule 1, on behalf of themselves and all members of the party.

1. Definitions and interpretation

1.1 In these Terms, unless the context otherwise requires:

  • “Company”, “we”, “us” or “our” means CJO Holdings LTD T/A Cromore Retreat

  • “Property” means Cromore Retreat, 52 Cromore Road, Portstewart, BT55 7PW, including its suites, grounds and facilities.

  • “Guest”, “you” or “your” means the Lead Guest and each member of the party.

  • “Lead Guest” means the person who makes the Booking and who is responsible for it.

  • “Booking” means a confirmed reservation of one or more suites at the Property.

1.2 Clause headings are for convenience only and do not affect the interpretation of these Terms.

2. Application of these Terms

2.1 These Terms, together with the booking confirmation and any documents expressly referred to in them, constitute the entire agreement between the Company and the Lead Guest and form a legally binding contract.

2.2 By making a Booking, the Lead Guest confirms that they accept these Terms on behalf of all members of the party and are authorised to do so.

2.3 The version of these Terms in force at the date of the Booking shall govern that Booking. The Company may amend these Terms for future bookings; the current version is available on the Company’s website.

3. The Booking

3.1 The Lead Guest must be at least 18 years of age and is responsible for the Booking, for payment of all sums due, and for the conduct of the party.

3.2 Bookings may be made through the Company’s website or through its authorised booking partners (see clause 7).

3.3 All prices are stated in pounds sterling and are inclusive of Value Added Tax at the prevailing rate (currently 20%).

3.4 The Company reserves the right to correct manifest errors in pricing. Where a price is found to be obviously incorrect, the Company will contact the Lead Guest to confirm or cancel the affected Booking.

3.5 A Booking is provisional until the Company issues written confirmation by email. The Lead Guest is responsible for checking that the confirmation is correct, including the dates of stay. The Company accepts no responsibility for bookings made for incorrect dates, and the cancellation provisions in clause 5 shall apply.

4. Payment

4.1 A deposit of 50% of the total price (the “Deposit”) is payable at the time of Booking.

4.2 The balance of the price is payable no later than 14 days before the arrival date. The Lead Guest may pay the balance at any time before that date through the guest portal at https://cromoreretreat.com/portal.

4.3 Where a Booking is made within 14 days of the arrival date, the full price is payable at the time of Booking.

4.4 The Lead Guest authorises the Company to retain their payment card details securely (held by the Company’s payment processor, Stripe) and to charge that card for the balance when due, and for any further sums properly payable under these Terms, including extras, additional charges and the cost of damage.

4.5 If the balance remains unpaid after the due date and cannot be collected from the card on file, the Company may treat the Booking as cancelled by the Lead Guest, in which case the Deposit shall be non-refundable and clause 5 shall apply.

5. Cancellation, amendment and non-arrival

5.1 Cancellation by the Guest more than 14 days before arrival: the Company will refund sums paid.

5.2 Cancellation by the Guest within 14 days of arrival: no refund is payable, save that, if the Company is able to re-let the suite for the same dates at the full rate, it will refund sums paid in the form of a non-transferable gift card. The Company will take reasonable steps to re-let but does not guarantee that it will do so.

5.3 Non-arrival: failure to arrive without prior notice shall be treated as a cancellation within 14 days and the full price shall be payable.

5.4 Amendments: requests to amend the dates of a Booking will be considered subject to availability and to any difference in price, but the Company is under no obligation to agree. Cancellations and amendment requests must be made in writing to info@cromoreretreat.com.

5.5 Cancellation by the Company: if the Company is required to cancel or materially alter a Booking (for example, where the Property cannot be operated safely), it will offer the Lead Guest alternative dates or a full refund of sums paid. Such alternative dates or refund shall be the limit of the Company’s liability in those circumstances.

6. Consumer rights

6.1 Nothing in these Terms affects the Guest’s statutory rights as a consumer under the Consumer Rights Act 2015 and other applicable law.

6.2 Bookings of accommodation for specific dates are exempt from the statutory 14-day cancellation (cooling-off) right under the Consumer Contracts Regulations 2013.

7. Bookings made through third-party platforms

7.1 Where a Booking is made through a third-party platform (such as Booking.com or Airbnb), that Booking is also subject to the terms and conditions of the relevant platform.

7.2 In the event of any conflict, the platform’s terms shall govern the matters which they address, in particular cancellation, refunds and payment, and these Terms shall govern all other aspects of the stay, including house rules, guest conduct, health and safety, use of facilities and responsibility for damage.

7.3 Claims for damage or breach of house rules in respect of platform bookings shall be pursued, where applicable, through the relevant platform’s resolution process and within its time limits.

8. Age, occupancy and guests

8.1 All Guests must be at least 16 years of age. The Property does not accommodate children or younger persons.

8.2 Each suite has a maximum occupancy of [2] persons. The number of persons staying must not exceed the number stated in the Booking.

8.3 Only registered, paying Guests may stay overnight or use the facilities. Day visitors are not permitted.

8.4 The Company reserves the right to verify the identity and age of Guests on arrival, and to refuse admission where it is not satisfied.

9. Arrival and departure

9.1 Check-in is available from 4:00 PM. Check-out is by 11:00 AM on the day of departure. Late check-out may be available by prior arrangement and may incur an additional charge.

9.2 All vehicles must be left in the designated car park, and Guests travel to the suites on foot. Please bring suitable footwear, as paths may be uneven and unlit. Parking is at the Guest’s own risk, and the Company does not accept responsibility for any damage to, or loss of, vehicles or their contents.

10. Hot tubs, sauna and facilities

10.1 The hot tubs and sauna are provided for the enjoyment of Guests and are used entirely at the Guest’s own risk. Guests must comply with the Hot Tub and Sauna Safety Rules set out in Schedule 1, which form part of these Terms, and the Lead Guest is responsible for ensuring that all members of the party are aware of and comply with them.

10.2 The sauna is available between 5:00 PM and 9:00 PM. The hot tubs and heating may be switched off overnight, between stays, and at other times for cleaning, energy efficiency, maintenance or safety, and availability hours may therefore vary. The hot tubs are open between check-in and 12PM

10.3 Persistent noise at the hot tubs, or failure to comply with the Safety Rules, may result in the hot tub being switched off without refund.

10.4 All facilities and communal areas are reserved for the exclusive use of paying Guests. Access to the bridle path is for Guests only.

11. Guest conduct and house rules

11.1 The Property is operated as a quiet retreat. Guests must respect the privacy and peace of other guests. Quiet hours are observed between 10:00 PM and 8:00 AM.

11.2 Parties, gatherings of non-resident persons and events are not permitted without the Company’s prior written consent. Any commercial use of the Property, including photography, filming or the operation of drones, requires the Company’s prior written consent.

11.3 Anti-social, abusive or disruptive behaviour, or any conduct that causes a disturbance to other guests, will not be tolerated. The Company reserves the right to refuse admission, or to require any Guest to leave the Property immediately and without refund, where these Terms are breached.

12. Extras and additional services

12.1 Extras (including, without limitation, hampers, breakfast, and cheese and charcuterie boards) may be added to a Booking, including through the guest portal.

12.2 Certain extras are supplied by independent third parties. The Guest is responsible for notifying the Company of any allergies or dietary requirements before arrival, and the Company accepts no liability in respect of allergens that have not been disclosed.

12.3 Extras may not be amended within 3 days of arrival and, once ordered, are generally non-refundable.

13. Gift cards, vouchers and promotional codes

13.1 Gift cards and vouchers are valid for [12] months from the date of issue unless otherwise stated, are non-refundable, may not be exchanged for cash, and may be redeemed once only.

13.2 Lost or stolen gift cards and vouchers cannot be replaced or refunded.

13.3 Promotional codes may not be combined. One promotional code may be applied per Booking, subject to the conditions applicable to that code.

14. Damage, loss and additional charges

14.1 The Guest is responsible for any damage caused to the Property or its contents during the stay, including any damage to, or tampering with, the hot tubs and their equipment as described in Schedule 1. The Company may charge to the card on file the cost of repair or replacement and any consequential loss of bookings.

14.2 The removal of items provided by the Company, including hand soaps, shampoos, eye masks, bathrobes and towels, will incur a charge determined by the Company.

14.3 Where excessive cleaning is required following departure, an additional charge may be applied.

14.4 The Company will retain lost property for a reasonable period and may return it at the Guest’s cost; uncollected items may be disposed of.

14.5 The Company is not responsible for loss of or damage to Guests’ personal belongings. Guests are advised to obtain appropriate travel insurance.

15. Prohibited items and activities

15.1 Smoking and the use of electronic cigarettes are strictly prohibited inside the suites. Designated outdoor areas are provided. Evidence of smoking indoors will result in a cleaning charge.

15.2 The use of candles, fireworks, sparklers and sky lanterns is not permitted anywhere on the Property by reason of fire risk.

15.3 Pets are not permitted at the Property.

15.4 The operation of drones or other unmanned aerial vehicles on or over the Property is prohibited without the Company’s prior written permission, in order to protect the privacy of Guests. A Guest who operates such a device without permission may be required to leave the Property immediately and without refund.

16. Health, safety and liability

16.1 The Property is a rural, outdoor site which includes hot tubs, a sauna, water, paths and natural terrain. Guests use the Property and its facilities at their own risk and must take reasonable care for their own safety and that of others, and must comply with the Safety Rules in Schedule 1.

16.2 Nothing in these Terms limits or excludes the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

16.3 Subject to clause 16.2, the Company’s total liability arising out of or in connection with a Booking, whether in contract, tort (including negligence) or otherwise, shall not exceed the total price paid for that Booking, and the Company shall not be liable for any loss that was not reasonably foreseeable.

17. Closed-circuit television (CCTV)

17.1 CCTV operates in communal and car-parking areas of the Property for the safety and security of Guests and the Property. No CCTV operates inside the suites or in the hot tub or sauna areas.

17.2 Footage may be disclosed to the police or other relevant authorities where the Company suspects criminal activity. CCTV is operated in accordance with the Company’s Privacy and Cookie Policy.

18. Data protection and communications

18.1 The Company processes personal data in accordance with its Privacy and Cookie Policy, which is available on its website.

18.2 The Guest acknowledges that the Company will send service communications by email and SMS in connection with the Booking (including confirmation, balance reminders, check-in information and a post-stay review request). Marketing communications are sent only with the Guest’s consent and may be withdrawn at any time.

19. Extreme weather and travel disruption

19.1 The Company is not liable for any cancellation or non-arrival by the Guest arising from extreme weather or travel disruption, and the provisions of clause 5 shall apply. Guests are strongly advised to obtain travel insurance.

19.2 If the Company is unable to operate the Property safely, it will offer the Guest alternative dates or a full refund in accordance with clause 5.5.

20. Force majeure

20.1 The Company shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control, including (without limitation) natural disasters, severe weather, fire, failure of utilities or telecommunications networks, epidemic or pandemic, and acts of government.

21. Complaints

21.1 If any aspect of the stay is unsatisfactory, the Guest should notify the Company as soon as possible, in person or at info@cromoreretreat.com, so that the Company has the opportunity to resolve the matter during the stay.

22. General

22.1 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

22.2 A Booking is personal to the Lead Guest and may not be assigned, resold or transferred without the Company’s consent.

22.3 No failure or delay by the Company in exercising any right under these Terms shall operate as a waiver of that right.

23. Governing law and jurisdiction

23.1 These Terms, and any dispute or claim arising out of or in connection with them, are governed by the law of Northern Ireland and are subject to the exclusive jurisdiction of the courts of Northern Ireland, subject to the Guest’s statutory rights as a consumer.

Schedule 1: Hot Tub and Sauna Safety Rules

These Safety Rules form part of the Terms and Conditions of Booking. By making a Booking and by using the hot tubs and sauna, the Guest agrees to comply with these rules. The hot tubs and sauna are used entirely at the Guest’s own risk, and the Lead Guest must ensure that all members of the party are aware of and comply with them.

A. Hot tub safety

  • The hot tub must not be used during pregnancy.

  • The hot tub must not be used by anyone with a heart condition, high or low blood pressure, circulatory problems, diabetes, epilepsy, or any other medical condition, without first obtaining advice from their doctor. Anyone taking prescribed medication should consult their doctor before use.

  • Alcohol must not be consumed in or around the hot tub, and the hot tub must not be used while under the influence of alcohol, drugs, or medication that causes drowsiness. The combination of hot water and alcohol or drugs can cause drowsiness, which may lead to unconsciousness and a risk of drowning.

  • Please shower and use the toilet before entering. Do not apply suntan lotion, fake tan, body oils or skin creams before use, as these contaminate the water and damage the filtration system.

  • The water is maintained at approximately 38 degrees Celsius and must never exceed 40 degrees Celsius. Please test the water with your hand before entering.

  • Limit each session to approximately 15 to 20 minutes, remain well hydrated, and always keep your head above the water. Prolonged immersion in hot water can cause overheating, the symptoms of which include dizziness, drowsiness and fainting. Leave the water immediately and seek assistance if you feel unwell.

  • Do not use the hot tub immediately after a heavy meal or after strenuous exercise.

  • Persons with any infectious or contagious condition, or with open wounds, must not use the hot tub.

  • No glass, bottles or other breakable items are permitted in or near the hot tub. Diving, jumping, and sitting or standing on the cover are not permitted. Surfaces around the hot tub can be slippery, so please take care.

  • Keep long hair tied back, and keep loose clothing and jewellery away from the jets and suction fittings. Do not exceed one person per seat. Do not use electrical items in or near the hot tub.

  • Do not remove or interfere with the cover, the operating or control panel, the jets, suction fittings, filters or pump, and do not adjust the temperature or chemical settings. Please replace the cover when the hot tub is not in use, and report any fault to the Company without delay.

B. Damage, tampering and charges

  • Any damage to, or tampering with, the hot tub or its equipment (including the cover, lifting mechanism, control panel, jets, pump, filtration or heater), and any contamination of the water (for example with soap, shampoo, oils, fake tan, food or alcohol) requiring the hot tub to be drained, cleaned and refilled, will be charged to the Guest responsible in accordance with clause 14. Such charges may include the cost of repair, replacement, draining, cleaning, re-treating and refilling, and any loss of revenue from bookings that cannot proceed while the hot tub is out of use.

C. Sauna safety

  • The sauna is available between 5:00 PM and 9:00 PM.

  • The sauna must not be used during pregnancy, or by anyone with a heart condition, blood-pressure or other medical condition, without first obtaining medical advice.

  • Do not use the sauna while under the influence of alcohol or drugs. Keep sessions short and remain well hydrated, and leave immediately and seek assistance if you feel unwell.

  • Do not bring flammable items into the sauna, and do not place anything on the heater.

D. In an emergency
